Terms of Use Agreement – Introduction
Saeel Online Store welcomes you and informs you that the terms and conditions outlined below govern your use of this store and all legal effects arising from the use of the store’s services via the internet.
The use of the store by any person whether as a consumer of the store’s services or products or for any other purpose—constitutes an explicit acknowledgment and full acceptance, by a person with full legal capacity recognized under Sharia, regulatory, and legal standards, of all the terms and provisions of this agreement, and an affirmation of full compliance with its contents.
This agreement applies to all types of transactions between the consumer and the store and becomes valid and legally binding immediately upon your approval and registration with the store, in accordance with Article Ten of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions
The above introduction forms an integral and inseparable part of this agreement. The following definitions apply to key terms used herein:
1- (The Store):
Refers to all forms of the store available via the internet, including but not limited to electronic applications, websites, or physical commercial outlets.
2- (The Consumer):
Any person who engages in e-commerce for the purpose of obtaining products or services provided by the store through its electronic platform.
3- (The Agreement):
Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties hereto.
Article Two – Legal Capacity of the Consumer
1- The consumer acknowledges having full legal capacity recognized under Sharia and applicable laws to deal with the store, or that they are at least eighteen (18) years of age.
2- The consumer agrees that any violation of this article shall render them fully responsible for the consequences thereof toward third parties.
Article Three – Nature of the Store’s Obligations
1- The store’s obligation toward the consumer(s) is to provide the agreed service or product.
2- The store may provide additional services, such as after-sales services or related services, depending on the nature and type of the requested service or product.
Article Four – Terms of Use
1- The consumer agrees to use the store’s electronic platform in compliance with public morals and applicable laws of the Kingdom of Saudi Arabia.
2- The consumer undertakes not to use any purchased service or product in a manner that violates public morals or applicable laws in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations
Upon applying for membership in the store, you are required to disclose specific information and choose a username and confidential password. By doing so, you agree to the following:
1- You are responsible for maintaining the confidentiality of your account information and password and must notify the store immediately of any unauthorized use or security breach.
2- The store shall not be liable for any direct or indirect material or moral loss resulting from disclosure of the consumer’s username or password.
3- You are solely responsible for your account, and any use by third parties shall be deemed authorized by you.
4- You agree to use the store with seriousness and good faith.
5- You commit to providing accurate, complete, current, lawful, and truthful information and to updating such information when necessary.
6- The store commits to maintaining the confidentiality of your personal and contact information.
7- If it is discovered that false, inaccurate, outdated, incomplete, or unlawful information has been provided, the store reserves the right to suspend, freeze, or terminate your membership or account without prejudice to its legal rights.
8- Failure to comply with the above grants the store the right to suspend or terminate your membership or deny access to the platform.
Article Six – Electronic Communications and Official Contact Methods
1- The parties agree that communication shall be conducted via the registered email address or mobile number, including SMS and approved communication channels.
2- The consumer agrees that all electronic communications shall have the same legal effect as written communications.
3- The store may notify consumers of matters related to this agreement via public or targeted electronic messages.
Article Seven – Amendments to the Agreement and Fees
1- The invalidity or cancellation of any provision shall not affect the validity of the remaining provisions.
2- This agreement constitutes the framework governing the relationship between the consumer and the store and may be amended as necessary.
3- The store may impose fees depending on offers, products, services, or government-imposed taxes.
4- The store reserves the right to modify, increase, reduce, or waive fees at its discretion.
Article Eight – Payment and Settlement Services
1- The store provides payment services through its partners using available electronic payment methods.
2- The store commits to pricing products and services in accordance with prevailing market value.
3- The store shall provide invoices and receipts for all transactions.
4- The store adheres to recognized accounting standards in its electronic platform.
Article Nine – Intellectual Property Rights
1- All intellectual property rights related to the store are fully owned by the store.
2- Consumers must respect the store’s intellectual property, including names, logos, trademarks, and content.
Article Ten – Store Liability
1- The store operates in compliance with Saudi laws and regulations.
2- The store is not liable for claims arising from errors or negligence caused by the consumer or third parties such as shipping companies.
3- Saeel Store ensures that its products and services are lawful, legitimate, and approved under Saudi regulations.
Article Eleven – Restriction or Termination of Access
The store reserves the right to suspend or terminate a consumer’s membership or restrict access to the platform at any time without prior notice.
Article Twelve – Governing Law
This agreement is governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia.
Article Thirteen – General Provisions
If any provision of this agreement becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This agreement constitutes the complete understanding between the store and the consumer. The parties agree that:
1- Arabic is the authoritative language for interpretation.
2- Prices are subject to change.
3- Promotional offers are temporary and may be modified or discontinued at any time.
4- The parties shall comply with Sharia principles and applicable laws.
5- This agreement may only be terminated by a decision issued by the store’s management.
